Por qué procesamos sus datos personales y con qué base legal
Dependiendo del modo que elija para interaccionar con nosotros, podremos tratar sus Datos personales para propósitos y con bases legales diferentes.

Procesar estos Datos personales es necesario para defender nuestro interés legítimo de garantizar que las transacciones son seguras y para evitar fraudes o usos indebidos de los servicios de pago (siempre respetaremos sus derechos y libertades y procesaremos sus Datos personales para defender nuestros intereses legítimos siempre y cuando no consideremos que sus derechos están por encima de nuestro interés legítimo).
- Es posible que debamos procesar sus Datos personales para cumplir obligaciones legales (como leyes administrativas y fiscales). Quiénes son los destinatarios de sus datos personales y dónde se encuentran situados
Almacenamos sus Datos personales en Suiza y en EE. UU. (porque nuestra empresa matriz, Guess Inc., se encuentra ubicada en EE. UU. y también usamos servidores de Guess Inc., situados en EE. UU., para fines de almacenamiento de datos).
Las transferencias de sus Datos personales desde la Unión Europea a Suiza se producen sobre la base de la decisión sobre adecuación de la protección de la Comisión Europea que reconoce a Suiza como un país que garantiza un nivel adecuado de protección de los datos personales. Las transferencias de sus Datos personales a EE. Durante cuánto tiempo conservaremos sus datos personales
Conservaremos sus Datos personales el plazo mínimo indispensable para llevar a cabo el propósito relevante para el cual los procesamos.
Conservaremos sus datos personales:
- Para la gestión de su cuenta como Usuario registrado, hasta que decida eliminar su cuenta;
- Para fines de gestión de sus pedidos, durante el plazo mínimo necesario para enviar los productos que haya comprado y gestionar devoluciones y reembolsos;
- Para fines de comprobación de que los Datos personales que haya indicado para completar una transacción son completos, válidos, precisos y no fraudulentos, hasta el cierre de la transacción;
- Para fines de cumplimento de las obligaciones legales pertinentes (como leyes fiscales y administrativas), durante el plazo estrictamente necesario para el cumplimiento de cualquier requisito aplicable;
- Para fines de tramitación de posibles demandas o procedimientos legales, durante el plazo estrictamente necesario para la tramitación de las demandas o el desarrollo del litigio y, en ningún caso, durante un plazo superior al periodo de limitación aplicable.

Medidas de seguridad
Hemos adoptado unas medidas de seguridad adecuadas para proteger frente a la pérdida, el uso inadecuado de, el acceso autorizado a y la alteración de sus Datos personales.
Cuáles son sus derechos y cómo ejercerlos
En cualquier momento, tiene derecho de:
- Acceso: podrá ponerse en contacto con nosotros en cualquier momento para acceder a sus Datos personales y le confirmaremos si estamos o no procesando sus Datos personales y para qué fines, además de darle detalles sobre las categorías de Datos personales afectadas, los destinatarios de dichos Datos personales y los plazos de conservación (previa solicitud, también podremos hacerle llegar una copia de sus Datos personales).
- Rectificación: si alguno de los Datos personales relativos a usted y en nuestra posesión fuera impreciso o estuviera incompleto, puede solicitar que lo corrijamos y completemos en cualquier momento.
- Eliminación: puede solicitar que eliminemos su cuenta como Usuario registrado o, en cualquier caso, solicitar la eliminación de sus Datos personales cuando ya no sea necesaria su retención por nuestra parte en relación con el propósito para el cual fueron recopilados. No obstante, debemos realizar el seguimiento de cierta información, como compras pasadas e información similar, para cumplir imperativos legales y, por tanto, en determinadas circunstancias, es posible que no podamos borrar íntegramente sus Datos personales.
- Restricción: en determinadas circunstancias, podrá solicitar que limitemos la manera en la que procesamos sus Datos personales (es decir, solicitar que sigamos almacenando sus Datos personales, pero no procesarlos sin su consentimiento). Estas circunstancias incluyen:
- cuando considere que los Datos personales relativos a usted y en nuestra posesión son imprecisos, puede restringir su tratamiento hasta su rectificación.
- cuando se opone a un tratamiento llevado a cabo sobre la base de que existe un interés público o un interés legítimo de nuestra parte, el tratamiento podrá quedar restringido hasta que se establezca si dicha base prevalece sobre sus intereses;
- cuando el tratamiento sea ilegal pero se opone al borrado de sus Datos personales y solicita, en su lugar, la restricción del uso de sus Datos personales; y
- cuando ya no precisemos los Datos personales, pero necesita los Datos personales para establecer, ejercer o defender una reclamación legal, nuestro procesamiento podrá quedar restringido.
- Oposición: cuando procesemos sus Datos personales sin su consentimiento para defender intereses legítimos, puede oponerse a este tratamiento sobre la base de su situación específica.
- Portabilidad: puede pedirnos que le enviemos sus Datos personales en un formato electrónico, estructurado, de uso frecuente y en un formato legible por máquina y solicitar la transmisión directa, por nuestra parte, de sus Datos personales a otro controlador de datos, siempre que sea técnicamente viable.
- Revocación de su consentimiento: en cualquier momento, puede decidir revocar su autorización para el tratamiento de sus Datos personales. La revocación no afecta a la legalidad del tratamiento basado en un consentimiento previo a la revocación.

Derecho a presentar una reclamación ante una autoridad de supervisión
Si considera que estamos procesando sus Datos personales de cualquier forma que pudiera suponer un incumplimiento de la legislación en materia de protección de datos, también tiene derecho a presentar una reclamación ante la Autoridad de protección de datos del Estado miembro de la UE donde reside habitualmente, trabaja o donde haya tenido lugar el supuesto incumplimiento.

Derecho a revocar su autorización y a oponerse al tratamiento de los datos para fines de marketing
En cualquier momento, puede decidir revocar su autorización para el tratamiento de sus Datos personales para la recepción de nuestro Boletín de noticias u oponerse a dicho tratamiento. En cualquier caso, dejaremos de enviarle nuestro Boletín de noticias.
Puede ejercitar estos derechos usando cualquier otro método de contacto indicado en el apartado «Contacte con nosotros» de nuestra página web www.guess.eu. Para revocar su autorización para recibir nuestro Boletín de noticias también puede hacer clic en el enlace incluido en cualquier comunicación de marketing que reciba. Cuáles son sus otros derechos y cómo ejercerlos
En cualquier momento, tiene derecho a:
(i) Solicitar el acceso a sus Datos personales y le confirmaremos si estamos o no procesando sus Datos personales y para qué fines, además de darle detalles sobre las categorías de Datos personales afectadas, los destinatarios de dichos Datos personales y los plazos de conservación (previa solicitud, también podremos hacerle llegar una copia de sus Datos personales).
(ii) Solicitar la rectificación de sus Datos personales en el menor plazo posible, si alguno de los Datos personales relativos a usted y en nuestra posesión fuera impreciso o estuviera incompleto;
(iii) Solicitar la eliminación de sus Datos personales cuando ya no sea necesaria su retención por nuestra parte en relación con el propósito para el cual fueron recopilados (no obstante, debemos realizar el seguimiento de cierta información, como compras pasadas e información similar, para cumplir con imperativos legales y, por tanto, en determinadas circunstancias, es posible que no podamos borrar íntegramente sus Datos personales);
(iv) Restringir, en determinadas circunstancias, la forma en la que procesamos sus Datos personales, por ejemplo, cuando considere que los Datos personales recopilados que se refieren a usted no son precisos (en este caso, el tratamiento podrá verse restringido hasta que los Datos personales se modifiquen);
(v) Recibir sus Datos personales en un formato electrónico, estructurado, de uso frecuente y en un formato legible por máquina y solicitar la transmisión directa, por nuestra parte, de sus Datos personales a otro controlador de datos, siempre que sea técnicamente viable.
Asimismo, cuando procesemos sus Datos personales sin su consentimiento para defender intereses legítimos, puede oponerse a este tratamiento sobre la base de su situación específica.

Qué datos personales recopilamos, cómo los usamos y por qué
(i) Elaboración de perfiles. Además de los datos que indica al cumplimentar la tarjeta del programa Guess List o el formulario de suscripción a nuestro Boletín de noticias, nosotros recopilamos y analizamos información relacionada con sus compras en línea y en tienda de productos Guess, para conocer y predecir sus preferencias («elaboración de perfiles») para que podamos enviarle Comunicaciones de marketing personalizadas que creemos serán de su interés. Más específicamente, cada vez que usted (1) se identifica como miembro del programa Guess List al comprar productos Guess en las tiendas Guess o (2) realiza un pedido a través de nuestra Página web, recopilamos y analizamos los datos relativos a su compra (por ejemplo, el producto comprado, su color y el precio).
(ii) Marketing. Recopilamos los datos que indica al cumplimentar la tarjeta del programa Guess List o el formulario para suscribirse a nuestro Boletín de noticias y utilizamos esta información para enviarle nuestras Comunicaciones de marketing personalizadas. Utilizamos su fecha de nacimiento para enviarle comunicaciones en las que le informamos de ofertas con descuentos especiales en su cumpleaños. Además de usar el correo electrónico, si indica su número de móvil, lo utilizamos para enviarle nuestras Comunicaciones de marketing personalizadas por SMS, MMS o llamada telefónica y, si indica su dirección postal, la utilizamos para enviarle nuestras comunicaciones por correo. Asimismo, si nos da su autorización, es posible que comuniquemos su dirección de correo electrónico a redes sociales (Facebook e Instagram) y a la plataforma digital Google, que procesará estos datos personales para establecer si usted tiene una cuenta registrada con ellos para que publicidad relativa a productos Guess en los que pueda estar interesado se muestre, mediante anuncios tipo banner, durante el uso de sus servicios.
En este aviso de privacidad, nos referiremos a todos los datos personales arriba descritos (es decir, información relativa a sus compras en línea y en tienda de productos Guess y a los datos que indica al cumplimentar la tarjeta del programa Guess List o el formulario para suscribirse a nuestro Boletín de noticias) de forma colectiva como «Datos personales».
No recopilaremos datos personales de personas menores de 18 años. El programa Guess List y el Boletín de noticias solo están disponibles para las personas mayores de 18 años.
Base legal para procesar sus datos personales
Llevamos a cabo actividades de elaboración de perfiles basadas en nuestro interés legítimo de conocer las preferencias de nuestros clientes con el objetivo de poder personalizar mejor nuestras ofertas y, en última instancia, ofrecer unos productos que mejor se adapten a las necesidades y los deseos de nuestros clientes. Esta elaboración de perfiles no implica una toma de decisiones individual automatizada que tenga efectos legales respecto a usted o que le afecte de manera significativa. Almacenamos sus Datos personales en Suiza y en EE. UU. (porque nuestra empresa matriz, Guess Inc., se encuentra ubicada en EE. UU. y también usamos servidores de Guess Inc., situados en EE. UU., para fines de almacenamiento de datos). Las transferencias de sus Datos personales a países a los que la Comisión Europea no ya reconocido la aplicación de un nivel adecuado de protección (como EE. Durante cuánto tiempo conservaremos sus datos personales
Conservaremos sus Datos personales el plazo mínimo indispensable para llevar a cabo el propósito relevante para el cual se procesan. Derecho a revocar su autorización y a oponerse al tratamiento de los datos
En cualquier momento, puede decidir que prefiere no recibir Comunicaciones de marketing personalizadas a través de ninguno de los canales (correo electrónico, SMS, MMS, llamadas de teléfono y correo) que usamos sobre la base de los datos de contacto indicados por usted. Puede hacerlo, usando cualquier otro método de contacto indicado en el apartado «Contacte con nosotros» de la Página web.
En cualquier momento, puede decidir revocar su autorización para el tratamiento de sus Datos personales para los fines descritos en este aviso de privacidad y oponerse al tratamiento de sus Datos personales para fines de marketing directo, como la elaboración de perfiles asociada a dicho marketing directo.
Si revoca su autorización o si se opone al tratamiento, se dará de baja en el programa Guess List y en el Boletín de noticias para que no vuelva a recibir de nosotros Comunicaciones de marketing personalizadas (además, dejaremos de elaborar perfiles sobre usted).

Cuáles son sus derechos y cómo ejercerlos
Tiene derecho de:
- Acceso: podrá ponerse en contacto con nosotros en cualquier momento para acceder a sus Datos personales y le confirmaremos si estamos o no procesando sus Datos personales y para qué fines, además de darle detalles sobre las categorías de Datos personales afectadas, los destinatarios de dichos Datos personales y los plazos de conservación (previa solicitud, también podremos hacerle llegar una copia de sus Datos personales).
- Rectificación: si alguno de los Datos personales relativos a usted y en nuestra posesión fuera impreciso o estuviera incompleto, puede solicitar que lo corrijamos y completemos en cualquier momento.
- Eliminación: puede solicitar que eliminemos sus Datos personales cuando ya no sea necesaria su retención por nuestra parte en relación con el propósito para el cual fueron recopilados.
