Who the Recipients of Your Personal Data Are and Where They Are Located
We store your Personal Data in Switzerland and in the United States (as our parent company, Guess Inc., is in the United States and we also use Guess Inc.’s servers, located in the United States, for data storage purposes).
Transfers of your Personal Data from the European Union to Switzerland occur on the basis of the European Commission’s adequacy decision that recognizes Switzerland as a country ensuring an adequate level of protection for personal data. Transfers of your Personal Data to the United States, which is a country that the European Commission has not recognized as ensuring an adequate level of protection, occur on the basis of appropriate measures designed to protect personal data contained within binding legal agreements (EU model clauses). You can request a copy of these clauses by sending an e-mail to dpo.privacy@guess.eu.
We communicate your Personal Data that we use for the purposes described under letters a), b) and c) of the section “Why We Process Your Personal Data and on What Legal Bases)” to third parties that process your Personal Data on our behalf, such as suppliers of IT services, payment service providers, carriers, and companies that carry out customer care services on our behalf.
Additionally, if necessary in connection with the handling of any claim or legal proceeding or for complying with legal obligations, we may also communicate your Personal Data to external advisors. We may also need to use, share or disclose your Personal Data if required in response to litigation, investigations or for other legally required disclosures.
We exercise appropriate due diligence in the selection of third parties, take all steps reasonably necessary to ensure that they process your Personal Data securely, only as instructed by us and for no other purposes, as well as that any transfer outside the European Economic Area is in accordance with applicable data protection laws.

For How Long We Retain Your Personal Data

Erhobene personenbezogene Daten, Modalitäten und Zwecke der Verwendung
(i) Profiling. Außer den Daten, die der Kunde beim Ausfüllen der Karte des Programms Guess List oder des Anmeldeformulars zu unserem Newsletter bereitstellt, erheben und analysieren wir Informationen in Bezug auf die Online- und Instore-Käufe von Guess-Produkten seitens des Kunden, um die Vorlieben des Kunden besser zu verstehen und vorherzusagen („Profiling“) und um dem Kunden somit personalisierte Marketingmitteilungen zuzusenden, die unseres Erachtens seinem Interesse entsprechen. Genauer gesagt erfassen und analysieren wir jedes Mal, wenn der Kunde (1) beim Kauf von Guess-Produkten in Geschäften von Guess als im Programm Guess List eingetragenes Mitglied identifiziert wird oder (2) eine Bestellung über unsere Website aufgibt, die Daten in Bezug auf seinen Einkauf (z.B. das gekaufte Produkt, dessen Farbe und Preis).
(ii) Marketing. Wir erheben die Daten, die der Kunde beim Ausfüllen der Karte des Programms Guess List oder des Anmeldeformulars zu unserem Newsletter bereitstellt, und verwenden diese Informationen, um dem Kunden personalisierte Marketingmitteilungen zuzusenden. Wir verwenden das Geburtsdatum des Kunden, um ihm Mitteilungen zu speziellen Angeboten oder Rabatten anlässlich seines Geburtstags zuzusenden. Außer per E-Mail senden wir dem Kunden, wenn er auch seine mobile Telefonnummer angegeben hat, unsere personalisierte Marketingmitteilungen per SMS oder MMS oder rufen ihn direkt an. Wenn der Kunde seine Anschrift angegeben hat, verwenden wir diese, um ihm unsere Mitteilungen per Post zu schicken. Zusätzlich können wir, wenn der Kunde seine Einwilligung erteilt, die E-Mail-Adresse des Kunden an soziale Netzwerke (Facebook und Instagram) und die digitale Plattform Google weitergeben, die diese personenbezogenen Daten verarbeiten, um festzustellen, ob der Kunde ein registrierter Nutzer von ihnen ist oder ein Konto bei ihnen hat; auf diese Weise können Werbeanzeigen zu Guess-Produkten, die dem Interesse des Kunden entsprechen könnten, über Banner angezeigt werden, wenn der Kunde die Dienste dieser Websites nutzt.
In dieser Datenschutzerklärung beziehen wir uns mit der Bezeichnung „Personenbezogene Daten“ kollektiv auf alle oben beschriebenen personenbezogenen Daten (d.h. die Informationen in Bezug auf die Online- und Instore-Käufe von Guess-Produkten seitens des Kunden und die Daten, die dieser beim Ausfüllen der Guess List Karte oder des Anmeldeformulars zu unserem Newsletter bereitstellt).

Rechtsgrundlagen der Verarbeitung Ihrer personenbezogenen Daten

Die Empfänger der personenbezogenen Daten und wo sich diese befinden
Wir speichern die personenbezogenen Daten des Kunden in der Schweiz und in den Vereinigten Staaten (da sich unsere Muttergesellschaft Guess Inc. in den Vereinigten Staaten befindet und wir auch in den Vereinigten Staaten befindliche Server von Guess Inc. zu Datenspeicherungszwecken verwenden).
